TERMS AND CONDITIONS

1. For the purpose of this promotion the following definitions apply:

'Promoter' means Macquarie Media Network Pty Ltd, of 33-35 Saunders Street, Pyrmont NSW 2009;

'Promotion' means RUGBYLEAGUELIVE.com Fantasy League, and is a sports tipping promotion conducted during the course of the 26 rounds of the 2008 National Rugby League season, excluding the Finals, State of Origin series and any Test series;

'Round' means a singular round in the 2008 National Rugby League season excluding any round in the Finals, the State of Origin and any Test series;

'Rounds' means all rounds in the 2008 National Rugby League season excluding any rounds in the Finals, the State of Origin and any Test series;

'Promotion Period' means the period commencing at 12pm Australian Eastern Daylight Savings Time ('AEDST') on 11.02.08 and closing on 11.59pm Australian Eastern Standard Time ('AEST') on 08.09.08;

'Website' means rll.virtualsports.com.au.
 
2. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions and the Website Terms of Use. In the event of any inconsistency, these Terms and Conditions shall prevail. The laws of Australia apply to this Promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.

3. Entry is open to Australian residents and non-Australian residents, except where prohibited. Notwithstanding the foregoing, only Australian residents are eligible to win any prizes, excluding the directors, managers and employees (and their immediate family) of the Promoter and agencies associated with this Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. To enter, the entrant must firstly register by completing the online registration process at the Website during the Promotion Period. Entrants will be required to (a) choose a nickname/alias to identify their entry; (b) submit the name of their favourite NRL team; and (c) subject to any 'Salary Cap Limitations' as detailed on the Website, submit a complete NRL team of 25 players ('Chosen Team') comprising the following positions:

(a) 2 Fullbacks;
(b) 7 Wings or Centres;
(c) 2 Five Eights;
(d) 2 Halfbacks;
(e) 6 Front Row Forwards; and
(f) 6 Second Row Forwards.

5. Only one registration per an entrant (and per an email address) will be accepted. If invited to enter a particular league, entrants may enter their details to join that league during the registration process. Alternatively they can create up to three private or public leagues and invite others to join. If they do not select a league, entrants will automatically be entered into a public league. Subject to an entrant's eligibility to win a prize, an entrant's chances of winning a prize will not be affected by whether they join a public league or private league. Rankings as displayed on the Website include the rankings of all entrants, and not only the rankings of entrants that are eligible to win a prize, and therefore should not be relied upon as indication of who will a prize.

6. During registration entrants may refer the promotion to their friends via email using the refer-a-friend facility on the Website.  If an entrant refers a friend, they warrant that they have obtained their friend's consent to do so prior to sending the email. The entrant indemnifies the Promoter against any claims by any third party for the entrant's failure to do so.

7. Entrants may replace players in their Chosen Team via the 'Trade Page' on the Website, in accordance with any directions. Entrants may make a maximum of 30 player trades per the season, with a maximum of 2 trades in any given Round. Player trades must take place prior to the commencement of a particular Round to be eligible to be selected for that Round, and are subject to any Salary Cap Limitations as detailed on the Website. Players traded during the season do not get their aggregate points added or subtracted to the entrant's total. For sake of clarity, if the player is removed from, or added to the Chosen Team, only the points earned by that player for that entrant, prior to their removal or after their addition from the Chosen Team, in accordance with these Terms and Conditions, count towards the entrant's total.

8. After registration, entrants may enter all remaining Rounds that have not been locked out. Subject to clause 9, to enter a particular Round, the entrant must prior to the lockout period for that Round (as notified on the Website), submit their 'Round Team' comprising of 13 'Starting Players' and  4 additional 'Reserve Players' from their Chosen Team in the following positions:
 
(a) 1 Fullbacks;
(b) 4 Wings or Centres;
(c) 1 Five Eights;
(d) 1 Halfbacks;
(e) 3 Front Row Forwards; and
(f) 3 Second Row Forwards.
 
Reserve Players (up to 4) may be selected in any combination and in any position, from any players from their Chosen Team who are not Starting Players in their Round Team. Entrants may select a 'Team Captain' who will score double points, and select a 'Vice Captain' who will score double points in the event that the Team Captain does not play in the particular Round and receives a score of 0. 

9. If, after participating in a Round, an entrant does not amend their Round Team, their Round Team from the previous Round as selected by the entrant will be used, regardless of whether or not those players will be playing in the coming Round.

10. Entrants will score points based upon the performance of their selected players in their Round Team for the particular Round. Points will be awarded (or subtracted) for each performance statistic attributed to that player during the Round as follows:

11. The Promoter's decisions in relation to all aspects of this Promotion is final and no correspondence will entered into, including decisions in relation to the number of points that entrant may have earned.

12. Rankings of entrants from the last Round completed will appear on the Website. Rankings on the Website may not give a true indication of the eventual winner of a prize.

13. The prize selection process will take place at 12pm AEST on 10.09.08 at Vapormedia Pty Ltd, at 108/9-11 Claremont Street, South Yarra VIC 3141.  The entrant, from those entrants who are eligible to win a prize in accordance with clause 3, with the highest point score at the conclusion of all Rounds will win the prize of a Nintendo Wii and Sportsgame pack valued at $400. If there are more than two entrants with the equal highest number of points, a draw to separate those tied entrants will take place at the same time and place as the original prize selection process to determine the eventual winner. The winner will be notified by mail and email and phone and their name will be published on the Website on 10.09.08

14. Subject to any written directions from a lottery authority, the draw to award any unclaimed prize will take place at the same time and place as the original draw on 10.12.08. The winner, if any, will be contacted by email and mail and published on the website on 15.12.08.

15. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who in the opinion of the Promoter tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

16. Incomplete, indecipherable, incorrect or illegible entries will be deemed invalid. Entries containing inappropriate, offensive, derogatory or defamatory content, as determined by the Promoter will deemed invalid and may be removed from display.

17. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

18. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.

19. Total prize pool value is $400.
 
20. Prize is not transferable or exchangeable and cannot be taken as cash.

21. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any services supplied by the Promoter.

22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written direction from a Lottery Authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

23. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

24. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) the prize.

25. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose and such other purposes as detailed in Promoter's privacy statement at rll.virtualsport.com.au, disclose such information to third parties, including, but not limited to, prize suppliers and Vapormedia Pty Ltd. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter by emailing support@vitualsports.com.au. All entries become the property of the Promoter.

'Promotion' means RUGBYLEAGUELIVE.com NRL Footy  Tipping Promotion, and is a sports tipping promotion conducted during the course of the 30 rounds of the 2008 National Rugby League season, and also includes the Finals and State of Origin series;

'Round' means a singular round in the 2008 National Rugby League season including any round in the Finals, and the State of Origin series;

'Rounds' means all rounds in the 2008 National Rugby League season including any rounds in the Finals, and the State of Origin series;

'Promotion Period' means the period commencing at 9amAustralian Eastern Daylight Savings Time ('AEDST') on 11.02.2008 and closing on 5pm Australian Eastern Standard Time ('AEST') on 05.10.2008; and

Failure to take prize by a nominated date will result in the forfeiture of that prize and cash will not be awarded in lieu of that prize.

15. Subject to written directions from a regulatory authority, the draw to award any unclaimed prizes will take place at Vapormedia Pty Ltd at 108/9-11 Claremont Street, South Yarra VIC 3141 at 12pm AEST on 08.01.2009. In the event that a prize is no longer available the Promoter will award a prize of equivalent value and specification as determined by Promoter in its absolute discretion. Winners, if any, will be published on RUGBYLEAGUELIVE.com and, winners of prizes valued at over $250 will be published in The Australian on  14.01.2009.

SCHEDULE

Tipping Component:

How to Enter

(a) After registration, entrants may enter in all remaining Rounds of the Tipping Component which have not been completed or locked out during the Promotion Period.

(b) If the entrant wishes to provide their tips for a particular Round, they must do so before the lockout time for that Round, or the particular match (as notified on the Website),  by visiting the Website and submitting their tip entry including their Margin Score, in accordance with the instructions. For clarity, an entrant may choose and edit their entered tips for a Round at any time before the lockout time for that Round, or the particular match, as notified on the Website.

How Points are determined

(c) The object of this component is to achieve the highest number of points. Points will be awarded to each entrant in each Round after they have registered in accordance with the following:

TIPPING 
Correct Tip 1 Point
Incorrect Tip 0 Points
Drawn Match 1 Point
Bonus Score for tipping ALL winners correctly in any given Round 2 Points
Non-submission of tips for any given match AWAY team selected by default
Non-submission of Margin Prediction Average Margin Score for the Round will be awarded

(d) In the case where the entrant has registered after a Round or several Rounds have closed, the entrant will receive the average tips score (i.e. total number of points divided by entrants) for any previously completed Round prior to their registration, rounded down to the nearest whole number, with up to a maximum of 4 points being awarded for all missed Rounds.
(e) The Margin Score is used as a tie-breaker should more than one entry be ranked equally based on points. The Margin Score is calculated based on the difference between the submitted Margin Prediction and the actual result. For example, if a team is tipped to WIN by 10 points and the actual Result is a WIN by 5 points, the Margin Score awarded will be 5 points. If a team is tipped to WIN by 10 points and the team LOSES by 5 points, the Margin Score awarded is 15 points. The Cumulative Margin Score is the total of all Margin Scores awarded for all completed Rounds to date. The lowest Margin Score and Cumulative Margin Score is ranked highest.
Tipping Prizes
(f) Tipping Prizes are divided into the following three categories: 'Weekly Tipping Prizes', 'Major Tipping Prizes'.. Only selected entrants in accordance with Clause 3 are eligible to win Tipping Prizes.. Entries from entrants who are not eligible to win prizes will not be assessed for the purpose of determining any prize winners.
(g) The Prize Winner Selection Process will be conducted by a representative of Vapormedia Pty Ltd at 108/9-11 Claremont Street, South Yarra VIC 3141 ("Prize Winner Selection Location").
(h) Weekly Tipping Prizes will be determined at the Prize Winner Selection Location at 12pm on the Wednesday after the completion of each Round commencing on 19.03.2008 and concluding on 08.10.2008.
(i) There will be one Weekly Tipping Prize awarded for each Round (30 in total). Total potential prize pool for Weekly Tipping Prizes is up to $7,500.
(j) The eligible entrant who scored the most points in a Round will win the Weekly Tipping Prize for that Round of:  $250 in form of a cheque.. In the event of a tie between two or more eligible entrants with the equal highest score, the Weekly Tipping Prize winner will be the entrant who achieved the lowest Margin Score in that Round. If this fails to break the tie, the Weekly Tipping Prize winner will be the entrant with the lowest Cumulative Margin Score. If this fails to break the tie, the Weekly Tipping Prize winner will be the entrant who registered first.
(k) An eligible entrant can only receive the Weekly Tipping Prize once during the Promotion Period. If an eligible entrant has been a previous winner of the Weekly Tipping Prize, the runner up will be deemed the winner of that Weekly Tipping Prize for that Round. If the runner-up has also been a previous winner of that Weekly Tipping Prize, the second runner up will be deemed the winner of that Weekly Tipping Prize for that Round. This process applies to all Weekly Tipping Prizes and will occur in each Round, and continue until a winner of each Weekly Tipping Prize is identified. References to "runner up" means the eligible entrant who had the highest score but lost the last original tie-breaker to determine the initial winner OR in the absence of a tie-breaker, the eligible entrant who had the second highest score. Tie-breaker losers will prevail over the eligible entrants with the second highest score.
(l) Weekly Tipping Prize winners will be notified by email and phone .Weekly Tipping Prize winners' details will be published on the Website on the Wednesday following their win commencing on 19.03.2008 and concluding on 08.10.2008.
(m) Major Tipping Prizes will be determined at the Winner Selection Location at 12pm on 08.10.2008. There will be a total of three Major Tipping Prizes. The total Major Tipping Prize pool is valued at $5000.
(n) There will be three Major Tipping Prizes as follows: 1st place a cheque for $2,500, 2nd place a cheque for $1,500, and 3rd place a cheque for $1,000. The three eligible entrants who scored the highest number of points throughout all Rounds during the Promotion Period will win these prizes. If points do not adequately determine the three highest scorers and the order in which they are placed, those tied entrants' performance will be assessed according to the lowest Cumulative Margin Score achieved throughout all Rounds, with the lowest Cumulative Margin Score ranking higher. If this to fails to determine the final places, the places will be determined based on time of registration with the quickest ranking higher.
(o) Major Tipping Prize winners will be notified by email and phone. Major Tipping Prize winners' details will be published on the Website  on 15.10.2008 .
Eliminator Component:
How to enter
(a) After registration, entrants may enter in all remaining Rounds of the Eliminator Component which have not been completed or locked out. The Eliminator Component will only be conducted during the 2008 National Rugby League season excluding any round in the Finals, and the State of Origin series.
(b) If the entrant wishes to provide their tips for a particular Round, they must do so before the lockout time for that Round, or the particular match (as notified on the Website),  by visiting the Website and submitting their tip of one team that they tip to win and the Margin Prediction, in accordance with the instructions. Each entrant is only permitted to select the same team once during the Promotion Period.
How scores are determined
(c)  The objective of the Eliminator Component is to obtain the highest 'Win Streak Score' by correctly determining a winning team in each Round.
 (d)  The entrant will start with a Win Streak Score of 0. The entrant's Win Streak Score will be increased by 1 point for every Round where a winner is selected. If an entry is not submitted for any given Round, that Round is void and the Win Streak Score is maintained.
(e)  An incorrect tip breaks the Win Streak, and the participant's Win Streak Score is reset to 0 for the following Round.
(f)  The best Win Streak Score of the entrant is stored as the "Best Win Streak" and the entrant is ranked on this basis, until and if that Win Streak Score is improved upon by the entrant.
(g) If the entrant fails to submit their Margin Prediction for any given Round, the average Margin Score for that particular Round from ALL entries will be awarded.
(h)  In the case where the entrant has registered late, the entrant will receive the average Margin Score from all previously missed Rounds, based on ALL entries irrespective of the team selected.
(i) The Margin Score is used as a tie-breaker should more than one entry be ranked equally based on Win Streak Score. The Margin Score is calculated based on the difference between the submitted Margin Prediction and the actual result. For example, if a team is tipped to WIN by 10 points and the actual Result is a WIN by 5 points, the Margin Score awarded will be 5 points. Eliminator Prize
(i) The Eliminator Selection Process will be conducted by a representative of Vapormedia Pty Ltd at 108/9-11 Claremont Street, South Yarra VIC 3141 at 12pm AEST on 09.09.2008. Only selected entrants in accordance with Clause 3 are eligible to win the Eliminator Prize. Entries from entrants who are not eligible to win prizes will not be assessed for the purpose of determining any prize winners.
(j) The eligible entrant that achieves the highest Win Streak Score will win the Eliminator Prize which is a 2 volume book titled '100 Years of Rugby League' valued at $200. In the event of a tie between 2 or more eligible entrants with the highest Win Streak Score, the Elimination Prize Winner will be the person who achieved the lowest Cumulative Margin Score during the Promotion Period. If this fails to break the tie, the eligible entrant who registered on the Website first in time will be the winner.
(k) Eliminator Prize Winner will be notified by email, phone and mail. Eliminator Prize winner's details will be published on the Website  on 10.09.2008.
One Team Tip Component
How to enter
(a)  After registration, entrants may enter in all remaining Rounds of the One Team Tip Component which have not been completed or locked out. The One Team Tip Component will only be conducted during the 2008 National Rugby League season excluding any round in the Finals, and the State of Origin series.
(b)  At the time of registration, the entrant must select their favourite team, which will be used for the duration of the One Team Tip Component. The object for the entrant is to predict the score of their favourite team in each Round (i.e. the Margin Prediction) and achieve the lowest Cumulative Margin Score overall.
(c)  The Cumulative Margin Score is the total of all Margin Scores awarded for all completed Rounds to date. The Margin Score is calculated based on the difference between the submitted Margin Prediction and the actual result. For example, if a team is tipped to WIN by 10 points and the actual Result is a WIN by 5 points, the Margin Score awarded will be 5 points. If a team is tipped to WIN by 10 points and the team LOSES by 5 points, the Margin Score awarded is 15 points. The lowest Margin Score and Cumulative Margin Score is ranked highest.
(d) The entrant should submit the Margin Prediction for their team in each Round. If the entrant fails to submit their Margin Prediction for any given Round, the average Margin Score for that particular Round from ALL entries will be awarded. In the case where the entrant has registered late, the entrant will receive the average Margin Score from all previously missed Rounds, based on ALL entries irrespective of the team selected.
One Team Tip Prize
(e) The One Team Tip Selection Process will be conducted by a representative of Vapormedia Pty Ltd at 108/9-11 Claremont Street, South Yarra VIC 3141 at 12pm AEST on09.09.2008. Only selected entrants in accordance with Clause 3 are eligible to win the One Team Tip Prize. Entries from entrants who are not eligible to win prizes will not be assessed for the purpose of determining any prize winners.
(f) The eligible entrant that achieves the lowest Cumulative Margin Score over the Promotion Period in the One Team Tip component will win a block mounted and fully signed 2007 NSW State of Origin jersey valued at $600.  In the event of 2 or more eligible entrants achieving the equal lowest Cumulative Margin Score, the eligible entrant who registered on the Website first in time will be the winner.
(g) One Team Tip Prize Winner will be notified by email and phone . One Team Tip Prize winner's details will be published on the Website on  on 16.09.2008.
Refer-A-Friend Component

(a) The Refer-A-Friend Component is only open individuals who are eligible to win a prize in accordance with Clause 3.

(b) The Refer-A-Friend Component commences with the commencement of the Promotion Period and closes at 11.59PM AEST on March, 31st 2008.

(c) Eligible entrants may obtain entries in the Refer-A-Friend Draw by referring friends via the Refer-A-Friend section on the Website. For each friend referred, the eligible entrant will receive 1 entry. The Refer-A-Friend Draw will be conducted by a representative of Vapormedia Pty Ltd at 108/9-11 Claremont Street, South Yarra VIC 3141 at 12pm  AEST on 01.04.2008.  Refer-A-Friend Winner will be notified by email and phone. Refer-A-Friend Winner's details will be published on the Website 08.04.2008.

(d) The first valid entry drawn will win the prize of State of Origin Package, which includes 4 x tickets to a corporate box at ANZ Stadium in Sydney NSW for State of Origin Match 1 valued at $2,000.The winner and his or her companions will be responsible for all travel, accommodation and any other ancillary costs associated with attending the prize. All attendees must aged 18 years or over. The prize must be taken to coincide with the match.

League Component

(a)  The League Component is only open individuals who are eligible to win a prize in accordance with Clause 3.

(b)  Eligible entrants may obtain entries in the League Draw by personally creating leagues in the Promotion, in accordance with the instructions. For each league personally created, the eligible entrant will receive 1 entry. Each eligible entrant can create a maximum of 3 leagues, and obtain a maximum of 3 entries in the league Draw.

(c)       The League Draw will be conducted by a representative of Vapormedia Pty Ltd at 108/9-11 Claremont Street, South Yarra VIC 3141 at 12pm AEST on 08.10.2008. League Draw Winner will be notified by email and phone. League Draw Winner's details will be published on the Website on 15.10.2008.

(d)       The first valid entry drawn will win the prize of 4 x adult tickets to the Rugby League World Cup on 26.10.2008 in Sydney.  valued at  $2,000. The winner and his or her companions will be responsible for all travel, accommodation and any other ancillary costs associated with attending the prize.
